FashionJobsToday.com. Fashion Jobs Today and parent company and agents provide
its service to you subject to the following Terms of Agreement , which may be
updated by us from time to time without notice to you. You can review the most
current version of the Terms of Agreement at any time on this website.
ENTERTAINMENTJOBSONLINE
INC.
The following page states the Terms of Agreement under which the company
EntertainmentJobsOnline Inc. operates via the Web Site FashionJobsToday.com and
the terms of which users accept by using the site. If you do not accept the
terms please do not use the services provided by FashionJobsToday.com.
Otherwise by using the Web Site you indicate your acceptance to the Terms and
Conditions as stated.

and DESCRIPTION OF
SERVICE
FashionJobsToday.com
is a subscription only jobsite that lists current jobs in the fashion industry.
MONTHS ARE ACCUMULATED BY 30 DAY MONTHS IN RETROSPECT TO THE SUBSCRIPTION
TIMES. IT IS EACH USERS RESPONSIBILITY TO UNSUBSCRIBE BEFORE 48 HOURS OF
EXPIRATION TIME TO DEFER AUTOMATIC PAYMENT OF ANOTHER SUBSCRIPTION CYCLE. USERS
WILL AUTOMATICALLY BE CHARGED FROM CYCLE TO CYCLE (MONTHLY, YEARLY, ETC) UNLESS
THE USER CANCELS THEIR SERVICE.
USE OF WEB
SITE MATERIALS
Reproducing or copying of the software, information, and/or material on this
Web Site to any other server or location for further reproduction or
redistribution is expressly prohibited. Reselling or redistributing the
software, information, and/or material on this Web Site for free or for a fee
is expressly prohibited. Reselling or redistributing use of a membership or
account to third parties is expressly prohibited.
Violators will be prosecuted to the maximum extent possible.
DISCLAIMER
All material on this site is provided in good faith. No warranty is made for
the accuracy, availability, or content of information provided on the Web Site.
Your use of this information is at your sole risk. You release
FashionJobsToday.com in the event of a dispute with any users, from any known
or unknown claims, damages, and/or wrongdoing arising out of or in any way
connected with such disputes. FashionJobsToday.com is under no legal obligation
to control the information provided by other users which is made available
through the Web Site. You acknowledge and agree that you are solely responsible
for the form, content and accuracy of any resume or material placed by you on
the Web Site. Employer Partners are solely responsible for their postings on
the Web Site. FashionJobsToday.com is not to be considered an employer with
respect to your use of the Web Site and shall not be responsible for any employment
decisions, for whatever reason made by any entity posting opportunities on the
Web Site. FashionJobsToday.com DOES NOT guarantee that the web site will
operate error-free, therefore if your use of this web site or the material
results in damages, loss of time, or anything else relating to this issue FashionJobsToday.com
is NOT responsible for those costs.
INDEMNITY
You agree to
indemnify and hold FashionJobsToday.com and its subsidiaries, affiliates,
officers, agents, employees, partners and licensors harmless from any claim or
demand, including reasonable attorneys' fees, made by any third party due to or
arising out of Content you submit, post, transmit or otherwise make available
through the Service, your use of the Service, your connection to the Service,
your violation of the Terms of Agreement, or your violation of any rights of
another.
INDIVIDUAL
MEMBERSHIP
1.
The member is responsible for paying nominal subscription fees according to the
billing terms.
2. Member fees are non-refundable and non-transferable. You will receive a password and
account designation upon completing the Service's registration process. You are
responsible for maintaining the confidentiality of the password and account and
are fully responsible for all activities that occur under your password or
account. You agree to (a) immediately notify FashionJobsToday.com of any
unauthorized use of your password or account or any other breach of security,
and (b) ensure that you exit from your account at the end of each session. FashionJobsToday.com
cannot and will not be liable for any loss or damage arising from your failure
to comply.
3. You
understand and agree to act in a professional manner relating to any third
party companies that we post on our site. You also agree that you are entirely
responsible for all content that you upload, post, email, transmit or otherwise
make available to our third party entertainment companies and corporations.
Under no circumstances will FashionJobsToday.com be liable in any way for any
Content, including, but not limited to, any errors or omissions in any Content,
or any loss or damage of any kind incurred as a result of the use of any
Content posted, emailed, transmitted or otherwise made available via the
Service.
BILLING
Certain portions,
components, Content and features of the Web Site are only available to users
who purchase a subscription (“Fee-Based Services”). As a subscriber to one of
the Fee-Based Services, you agree as follows:
1. You agree to pay, using a valid
credit card, the fixed and periodic charges and fees set forth on this Web
Site, applicable taxes, and other charges and fees incurred in order to access
Fee-Based Services. The charges and fees on this Web Site are expressed in United States dollars and your credit card or other account will be charged in United States dollars. FashionJobsToday.com reserves the right to increase charges and
fees, or to institute new charges or fees at any time, upon reasonable advance
notice communicated to you through a posting on this Web Site or such other
means as FashionJobsToday.com may deem appropriate from time to time.
2. FashionJobsToday.com will automatically charge your credit card or other account at the start of the standard billing period and at the start of each renewal period, unless you terminate or cancel your subscription within 2 business days before the relevant renewal period begins. You must cancel all 4 Day memberships within 1 Day of your membership renewal date. Members must fill out the CANCELLATION REQUEST FORM located in our FAQ's in order for your membership to be canceled. Each time you use the Fee-Based Services you reaffirm your agreement that FashionJobsToday.com may charge your credit card (or other form of payment, if applicable). In the event FashionJobsToday.com cannot charge your account, Work In Sports reserves the right to terminate your access to our Fee-Based Services and the Web Site.
3. The 4 day
promotional trial membership does require cancellation. You must fill out
the CANCELLATION REQUEST FORM and submit it by the end of your third day. If the cancellation form is not submitted by the end of your third day, your trial membership will automatically be renewed as a month to month membership. Your credit card will be charged the nominal $14.99 fee per month until you have submitted the cancellation request form.
4. For purposes of your use of the Fee-Based Services including
identification and billing, you agree to provide FashionJobsToday.com with
true, accurate and complete information as required by the subscription or sign
up process to Fee-Based Services ("Subscription Data"), including
your legal name, address, telephone number, email address and applicable
billing information (e.g., credit card number and expiration date), and to
allow FashionJobsToday.com to share your Subscription Data with third parties
for the purpose of verifying the information you provide and billing your
credit card or otherwise charging your account. You agree to maintain and
promptly update the Subscription Data to keep it accurate.
AUTO
RENEWAL
Payment for a membership to FashionJobsToday.com shall be made by automatic credit card debit. Members will be automatically renewed for the original term upon expiration, unless a cancellation request is made at least 2 business days prior to membership expiration. All 4 Day memberships must be canceled within 1 day of expiration or those memberships will be renewed as a month to month membership. Members must fill out the CANCELLATION REQUEST FORM located in our FAQ's in order for your membership to be canceled.
TERMINATION OF SERVICES AND CANCELLATION POLICIES
1. FashionJobsToday.com.com reserves the right to pursue all of its legal
remedies in order to protect the Web Site and its users. Membership may be
terminated at any time by either FashionJobsToday.com or the member upon
notification by email. Member fees are not refunded when termination is
requested by the member. Members are responsible for charges incurred until
their monthly expiration date.
2. If you would like to continue as a member for longer than a month, your
credit card will be charged on your monthly membership anniversary date for
each consecutive month thereafter. Again, your monthly billing cycle begins the
day you register. If you do not cancel your membership within the 2 business
days of the monthly anniversary of your membership, your membership will
continue and your credit card will be charged for each consecutive month
thereafter. Your monthly billing cycle begins the day you register. To
CANCEL your membership, simply fill out the CANCELLATION REQUEST FORM located in our FAQ's
in order for your membership to be canceled.
PROPRIETARY
RIGHTS
You
acknowledge and agree that the Service and any necessary software used in
connection with the Service ("Software") contain proprietary and
confidential information that is protected by applicable intellectual property
and other laws. You further acknowledge and agree that Content contained in
information presented to you through the Service or by advertisers is protected
by copyrights, trademarks, service marks, patents or other proprietary rights
and laws. Except as expressly authorized by FashionJobsToday.com, you agree not
to modify, rent, lease, loan, sell, distribute or create derivative works based
on the Service or the Software, in whole or in part.
FashionJobsToday.com
grants you a personal, non-transferable and non-exclusive right and license to
use the object code of its Software on a single computer; provided that you do
not (and do not allow any third party to) copy, modify, create a derivative
work from, reverse engineer, reverse assemble or otherwise attempt to discover
any source code, sell, assign, sublicense, grant a security interest in or
otherwise transfer any right in the Software. You agree not to modify the
Software in any manner or form, nor to use modified versions of the Software,
including (without limitation) for the purpose of obtaining unauthorized access
to the Service. You agree not to access the Service by any means other than
through the interface that is provided by FashionJobsToday.com for use in
accessing the Service
